Processing of Personal Data

Information on the processing of personal data in accordance with Art. 13 of Regulation (EU) 2016/679

The Company MDJ COSTRUZIONI SRL (hereinafter referred to as "MDJ COSTRUZIONI" or "The Company"), with registered office in VIA NAZIONALE, 286 07051 BUDONI (SS), provides this Privacy Policy to explain how personal data voluntarily communicated within the professional relationship and during interaction with the Company are processed. Please read this information carefully and contact us in case of questions or doubts.

(a) Identity and Contact Details of the Owner

The owner of the personal data is the company MDJ COSTRUZIONI, with headquarters in VIA NAZIONALE, 286 07051 BUDONI (SS). You can contact us by email at:

(b) Purpose of the Processing and Legal Basis

Your personal data will be processed:

(i) even without the expression of your written consent (art.6, letters b, c, f, GDPR), exclusively for the following purposes:

• fulfill all the company's obligations arising from the assignment of a professional assistance or consultancy task, including the obligations connected to the preliminary evaluation phase for the purposes of assigning the task,

• fulfill all the obligations of the company imposed on it by provisions of law or regulation (national and community) and among them, by way of example only, the obligations for the orderly keeping of accounts and the fulfillment of tax obligations, the obligations of detection and conservation for the purposes of preventing money laundering, the obligations of identification and communication required by procedural rules for the exercise of rights in court,

• exercise the rights granted to the company for its own defense;

(ii) exclusively, subject to the expression of your consent (art.7, GDPR), for the following purposes:

• evaluation of requests for collaboration with the company,

• the organization of events, seminars, courses and other activities of a scientific or professional nature, not related to the specific performance of professional activity; the distribution of informative material, the request for reviews, the sending of questionnaires, newsletters and publications.

The communication of data for the purposes referred to in the previous section (i) is necessary for the execution of the assignment or the preliminary assessment of its acceptance and is therefore mandatory. Failure to communicate the data or any express refusal to their processing will make it impossible for the company to carry out the assignment conferred. The communication of data for the purposes referred to in the previous section (ii) is optional, with the consequence that you may decide not to provide your consent, or to revoke it at any time.

(c) Categories of Personal Data Processed

Within the scope of the purposes of the processing highlighted in the previous paragraph b) (i), in addition to personal data concerning, for example, name and surname, tax code, VAT number, residence, domicile, workplace, email address or certified email, telephone and fax number, corporate positions, employer company, role and/or company classification and similar, all data constituting necessary information, connected with the object of the assignment, for the expression of opinions, the exercise of assistance and consultancy activities, will be processed. Within the scope of the purposes of the processing highlighted in the previous paragraph b) (ii), only personal data concerning name and surname, tax code, VAT number, residence, domicile, workplace, email address or certified email, telephone and fax number will be processed.

(d) Recipients of Personal Data

The data may be shared with authorized collaborators, legal or professional collaborators, third parties involved in the activity, judicial authorities and public bodies, and external consultants. Personal data will not be disclosed.

(e) Storage and transfer of personal data abroad

Personal data is retained for the entire duration of the professional relationship and for the time required by law. Some data may be retained for up to 2 years after consent for the specific purposes indicated. No transfer of personal data abroad is contemplated. Your personal data will not be disclosed and will not be communicated without your explicit consent.

(f) Period of retention of personal data

Personal data collected for the purposes indicated in the previous paragraph (b), section (i) will be processed and stored for the time required by the purpose for which they were collected. Furthermore, the owner may be obliged to store personal data for a longer period whenever it is required to comply with a legal obligation or by order of an authority.

IThe personal data collected for the purposes indicated in the previous paragraph (b), section (ii) will be processed and stored for the time necessary to fulfill such purposes and in any case for no longer than 2 years from the date on which we receive your consent.

(h) Rights of the Data Subject

In accordance with the provisions of Chapter III, Section I, GDPR, you may exercise the rights indicated therein and in particular:

• Right of access - Obtain confirmation as to whether or not personal data concerning you are being processed and, where that is the case, receive information relating, in particular, to: the purposes of the processing, the categories of personal data processed and the retention period, the recipients to whom these may be communicated (Article 15, GDPR),

• Right to rectification - Obtain, without undue delay, the rectification of inaccurate personal data concerning you and the integration of incomplete personal data (Article 16, GDPR),

• Right to erasure - Obtain, without undue delay, the erasure of personal data concerning you, in the cases provided for by the GDPR (article 17, GDPR),

• Right to limitation - Obtain from the Data Controller the limitation of processing, in the cases provided for by the GDPR (article 18, GDPR)

• Right to portability - Receive in a structured, commonly used and machine-readable format, the personal data concerning you provided to the Data Controller, as well as obtain that they are transmitted to another data controller without impediments, in the cases provided for by the GDPR (article 20, GDPR)

• Right to object - To object to the processing of your personal data, unless there are legitimate reasons for the Data Controller to continue processing (Article 21, GDPR)

• Right to lodge a complaint with the supervisory authority - Lodge a complaint with the Data Protection Authority, Piazza di Montecitorio n. 121, 00186, Rome (RM). You may exercise these rights by simply sending a request via email to the company address indicated above.

(j) Changes to this Privacy Policy

The Company reserves the right to make changes to this privacy policy at any time by informing its Users on this page and possibly within this Website and/or - to the extent technically and legally possible - by sending a notification to Users via any contact information available to the Company. It is strongly recommended to check this page often, referring to the date of the last modification listed at the bottom.

(k) Methods of Processing

The processing of your personal data is carried out by means of the operations indicated in article 4, n.2, GDPR – performed with or without the aid of computer systems – and specifically: collection, recording, organization, structuring, updating, storage, adaptation or modification, extraction and analysis, consultation, use, communication by transmission, comparison, interconnection, limitation, cancellation or destruction.

In any case, the logical and physical security of the data and, in general, the confidentiality of the personal data processed will be guaranteed, by implementing all the necessary technical and organizational measures adequate to guarantee their security.
